Trump Challenges Second Ruling That Blocks Tariff Authority

U.S. administration appeals federal decision that limits presidential powers under emergency economic law

Following a court decision from the U.S. Court of International Trade, a second federal ruling has again obstructed the Trump administration’s ability to impose tariffs. Now, the former president is appealing once more.

The Department of Justice has filed an emergency appeal against the ruling issued on May 29, which declared that the tariffs imposed were beyond the president’s powers under the International Emergency Economic Powers Act. That law authorizes economic action only in response to unusual and extraordinary threats during a national emergency.

Just one day earlier, on May 28, the Court of International Trade had already deemed those tariffs unlawful, though that verdict was quickly overturned by an appellate court.

This latest decision, signed by Judge Rudolph Contreras, had a more limited scope: it blocks the administration from collecting tariffs from two small toy manufacturers, Learning Resources Inc. and hand2mind, which had filed legal complaints.
