White House TV Pool Boycott Triggers DOJ Antitrust Investigation

Five of America’s biggest television networks now face federal scrutiny after collectively refusing to cover President Donald Trump ahead of November’s Midterm elections

A decision by the television networks at the heart of White House coverage to stop reporting on President Donald Trump has escalated into a federal antitrust investigation, thrusting some of the country’s most influential news organizations into an extraordinary legal confrontation with the U.S. government.

The Department of Justice announced it is examining whether a coordinated boycott by journalists from CNN, NBC, ABC, CBS and Fox News violated federal competition laws. The inquiry centers on the networks’ joint refusal to provide coverage of the president in the run-up to November’s Midterm elections.

At issue is the White House television press pool, the tightly organized system responsible for documenting presidential activities when access is limited. The arrangement allows participating broadcasters to rotate coverage duties during public appearances and official travel, with video, audio and reporting materials subsequently shared across the wider media landscape.

Federal investigators are now scrutinizing whether the networks crossed a legal line by acting in concert.

“Members of the television press pool boycotted coverage of White House events. Group boycotts among business competitors can violate the Sherman Act. The Antitrust Division is simply investigating to determine whether these news organizations violated antitrust laws,” Justice Department spokesperson Emily Covington said.

The significance of the case extends beyond a routine dispute between a president and the press. The networks under scrutiny are not peripheral players but the organizations that collectively form the backbone of broadcast coverage of the White House. Their decision effectively halted the pool system’s normal function at a politically charged moment, just weeks before voters head to the polls for the Midterm elections.

The investigation is focused on accredited television pool journalists from the five networks. Under normal procedures, pool members gather and distribute footage and information from presidential events on behalf of the broader press corps, ensuring coverage reaches newsrooms across the country.

Whether the networks’ collective action constituted protected editorial judgment or an unlawful boycott is now the question facing federal antitrust investigators. For the Justice Department, the issue is not the content of the coverage itself but whether direct competitors coordinated their conduct in a manner prohibited under the Sherman Act.
