Trump Media Ban Blocked as Judge Restores CNN, Politico and MSNBC Access
A federal judge found little evidence that national security concerns were behind the White House decision to revoke access credentials from several major news organizations
A federal judge has handed the Trump administration a significant legal defeat, ordering the White House to restore access for CNN, Politico and MSNBC while a closely watched lawsuit over press credentials moves through federal court.
The ruling from U.S. District Judge Timothy Kelly temporarily blocks the administration from enforcing restrictions imposed on the three news organizations, whose journalists challenged the decision after losing access to the White House. At the center of the dispute was the administration’s claim that national security concerns justified the revocation of credentials.
Kelly was unconvinced.
In a 26-page opinion, the judge wrote that there was virtually nothing in the record surrounding the White House decision that would allow the court to connect the exclusions to legitimate national security considerations. The finding undercut one of the administration’s principal justifications for barring the outlets.
Instead, the ruling pointed to a different explanation. Kelly concluded that Trump likely moved against the organizations because he viewed their reporting as inaccurate and politically biased against him. According to the judge, such a rationale raises serious constitutional concerns when access decisions affect members of the press.
The opinion determined that the administration likely violated protections guaranteed under both the First and Fifth Amendments, finding that the affected journalists were deprived of rights related to free expression and due process.
The decision restores White House access for CNN, Politico and MSNBC while the underlying legal challenge continues, ensuring that reporters from the organizations can return pending a final resolution of the case.
The order does not extend to every location from which journalists had been excluded. Reporters from CNN and Politico are not guaranteed access to more restricted presidential environments such as the Oval Office or Air Force One, and the administration is not currently required to reverse those separate limitations.
For now, however, the court’s intervention marks a major victory for the news organizations challenging the restrictions and a substantial setback for the White House effort to defend the exclusions on national security grounds.
