Cornell University Gang Rape Investigation Triggers Criminal Probe, Push for New York Consent Law Reform

New York officials announce a criminal investigation into allegations tied to Cornell’s Chi Phi fraternity while calling for changes to state law governing consent and intoxication

A criminal investigation has been launched into allegations of a gang rape at the Chi Phi fraternity house at Cornell University in 2024, marking a significant escalation in a case that has drawn scrutiny of both institutional responses and New York’s sexual assault laws.

New York Attorney General Letitia James announced the criminal probe during a press conference, saying her office is committed to conducting a comprehensive review of the allegations despite restrictions on what investigators can publicly disclose while the case is ongoing.

“I know you want answers. I want answers too,” James told reporters. “An investigation of this nature takes time, but my office is committed to seeing it through.” She added that additional information would be released when available, while noting limits on what can currently be shared.

The announcement came alongside a broader call from New York Governor Kathy Hochul to revise state law governing sexual assault and consent. Hochul argued that existing statutes fail to adequately protect victims who have voluntarily consumed alcohol or drugs before an alleged assault.

“A person can be too intoxicated to consent, but it should not matter whether they chose to take drugs or alcohol,” Hochul said at a press conference. “Voluntary intoxication is not a license for sexual assault or gang rape. Period.”

The governor said the issue exposes a gap in state law that requires immediate attention. She pledged to work with the New York State Legislature to change the statute, stating that protections should not depend on whether an individual became intoxicated by choice.

Hochul also focused on the experience of the woman identified in court filings as Jane Doe, who reported the alleged gang rape. According to the governor, the complainant was repeatedly failed by the institutions and individuals expected to safeguard her interests.

“This young woman has already endured something absolutely unspeakable and has been left to fend for herself by people and institutions that should have protected her,” Hochul said.

The governor announced that she had appointed James as special prosecutor in the matter, giving the attorney general responsibility for conducting a new investigation and pursuing criminal proceedings if the evidence warrants such action.

“No institution can protect its reputation at the expense of a young woman seeking justice,” Hochul said. She also argued that public officials cannot “look the other way when the system breaks down and fails our young people.”

The criminal investigation now underway will determine whether the facts of the case support criminal charges stemming from the allegations tied to the Chi Phi fraternity house at Cornell University.
